STANDARD CONTRACT TERMS
These Standard Contract Terms are incorporated into any agreement between NurseryTrees.com, LLC of Snohomish, Washington (“NurseryTrees.com”) and Customer, for NurseryTrees.com to provide trees and/or services. Please click on the following topics, or just scroll down to see all of them:
The Project details are defined in the Price Quote that NurseryTrees.com, LLC and the Customer have agreed-to. Please note that NurseryTrees.com sending Customer a Price Quote is not a commitment for those trees/services until all important details have been worked out and agreed-to by both parties, and the project has been added to NurseryTrees.com’s calendar.
Customer may cancel this agreement, for any reason and without penalty, at any time prior to the project starting.
Delivery & Planting: Here are the standard terms when NurseryTrees.com is planting trees for a Customer:
Planting includes staking if necessary, a watering system and a one year warranty at no additional charge. (More information on Warranty below).
NurseryTrees.com’s Price Quote is based upon decent-quality soil, good drainage, no underground obstructions, and reasonable access to the planting area. In the unusual event there are any problems in these areas such as an unexpected underground obstruction, additional charges may be involved. NurseryTrees.com will discuss any issues with Customer upon discovering the problem prior to proceeding/continuing with the work.
Customer is responsible for knowing where their property boundaries are and whether there are any legal restrictions on planting trees.
Customer will pay for the work upon completion of the project and Customer being satisfied with the work (see “Payment” section below).
Customer Pick-Ups: Here are the standard terms when Customer is just picking up trees at the NurseryTrees.com farm:
Compliance with weight limits and other transportation-related legal restrictions are the responsibility of the Customer, as is the proper securing of the load.
Warranty: No warranty on picked-up trees.
Customer will pay for the trees prior to or at pick-up (see “Payment” section below).
“Delivery Only”: When we “Deliver Only” trees to a Customer’s location, with Customer or their landscaper to then plant the trees, here are the standard Price Quote provisions:
“Delivery Only” means that we will place the trees beside where we can park our truck. By special arrangement we can move the trees from our truck to the planting area but there may be an additional charge for this.
Warranty: No Warranty on trees that we just deliver.
Customer will pay for the trees prior to or upon delivery. (see “Payment” section below).
Unless stated otherwise in the Price Quote, NurseryTrees.com does not require any money “up front” or “on deposit”—Customers only pay when the job is completed and they are satisfied.
Upon completion of the work, payment may be made by check, cash, or most major credit cards—VISA, Mastercard, American Express. NurseryTrees.com does charge a 3% credit card surcharge as listed in Customer’s Price Quote. Credit card payments may be made over the phone or using a secure online portal that NurseryTrees.com will e-mail Customer a link to.
When NurseryTrees.com plants trees for Customers, a one-year Warranty is included for no additional charge. It is unusual for NurseryTrees.com to have to replace our professionally-planted trees, but trees are living things so it does happen; and when it does it is good to have this Warranty.
Please Use NurseryTrees.com’s Watering System: Proper Watering is very important for newly-planted trees. For this reason NurseryTrees.com includes an above-ground, temporary, watering system as part of its planting services. This Warranty applies if Customer has made a good-faith effort to properly water the new trees using the watering system NurseryTrees.com has installed. There is a lot of valuable information about watering and the watering system in the “Care of Your Trees” section of NurseryTrees.com’s website. NurseryTrees.com is also available by phone and e-mail, and Customers are encouraged to use this service so that your questions are answered. (There is no charge for this, of course).
This Warranty does not apply damage to Customer’s trees from “Acts of Nature” such as floods, windstorms, animal damage (including deer), etc. or intentional/negligent action by others such as vandalism or automobile-caused damage. It also does not apply to trees that NurseryTrees.com has transplanted for Customers—trees Customers already owned but NurseryTrees.com just moved at Customer's request.
If this Warranty applies, NurseryTrees.com will replace and dispose of any trees that need replacing, without any charge, for one year after planting. NurseryTrees.com’s responsibility is to replace the tree(s) Customer purchased or, if such tree(s) are unique or not something NurseryTrees.com has growing/in stock, refund Customer’s money (tree cost and planting charges) at NurseryTrees.com’s option.
Warranty Transferrable: If Customer sells their property during this Warranty period, the remaining term of this Warranty transfers to the purchaser as long as there has not been any lapse in watering caused by the property sale..
Other than the Warranty described in the previous section, there are no other warranties express or implied and NurseryTrees.com is not responsible for any direct, indirect, special or consequential damages incurred by Customer; or damages of any sort above the amount Customer has paid to NurseryTrees.com. The agreement with Customer does not create any legal rights for third-parties (except later owners of Customer's property if within the Warranty term)..
If NurseryTrees.com is unable to provide the trees and/or services specified in the Price Quote because of tree damage such as that caused by insects/animals/disease, vandalism or theft, labor disruption (including but not limited to Covid-19), natural disaster or environmental changes, changes or cessation of business activities, or any similar event, NurseryTrees.com may cancel this agreement.
Customer may cancel this agreement, for any reason and without penalty, at any time prior to the project starting.

Privacy Trees: We are a nursery tree farm specializing in Privacy Trees for screening. We have several thousand privacy trees growing at our Snohomish farm. Plus we have many years' experience in "what works where", professional planting services, ongoing support, and thousands of satisfied customers. Buying directly from a grower has great advantages--fresh trees, great selection, and low prices--you maximize your purchasing power. Free Estimates: We will help you determine which trees are right for your project, and provide you with free, no-obligation estimates. This is often accomplished by e-mail and phone, usually first using our online Free Estimate Request Form. Where necessary, we will send one of our experts out to review the project (no cost or obligation). More information
Location: We’re conveniently located just 15 minutes north of Woodinville. We’d be happy to have you out. We are a farm, not a retail nursery so we don't keep regular retail hours; instead we set up appointments so that we can focus on your project. More information

Payment: We don’t require any money “up front”—you only pay when the job is completed (unusual exceptions to this are large/special projects or lengthy “holds” on trees). Be careful of contractors asking for “up front” money; they might not come back!
Warranty & Support: When we plant your trees we include staking (if necessary), transplanting fertilizer, and an easy-to-use watering system that hooks into your garden hose. More information. We sell retail & wholesale, for residential and commercial projects. We are a registered Washington State contractor (License Number: NURSEL*956J1). More information Be sure to hire a registered contractor -- to go to the Department of Labor & Industries website to check a contractor's registration, click here. As it says there: "Unregistered contractors carry no bond or insurance to protect consumers. Consumers can face serious issues if anything goes wrong on a job." These liability risks are in addition to fraud, poor workmanship, worthless warranties, etc. We are fully bonded and insured, of course.
